In a move to take the heat off the Nigerian Army and ensure that due process is followed, Pres. Buhari has signed a presidential proclamation proscribing IPOB over the group’s involvement in terrorist activities, ThisDay reports.
According to sources in the Office of the Attorney General of the Federation, the president signed the declaration on Sunday before his departure for the 72nd United Nations General Assembly (UNGA) in New York, where he will be expected to address other world leaders today.
Buhari’s decision to sign the proclamation was a fallout of the sharp criticism that followed the declaration of IPOB as a terrorist organisation by the Nigerian Army at the weekend and the group’s proscription by the South-east governors.
With the signing of the proclamation by Buhari, a source in the attorney general’s office explained that the presidency had effectively initiated the formal process of proscribing IPOB in accordance with the provisions of the Terrorism (Prevention) Act, 2011.
It also paved the way for the Attorney General of the Federation (AGF), Mr. Abubakar Malami (SAN) to head to court to give legal backing to the presidential proclamation.

Senate President Bukola Saraki says the categorisation of the Indigenous People of Biafra (IPOB) as a terrorist organisation by the defence headquarters and proscription of the group by south-east governors did not follow due process.
The military and governors from the south-east moved against IPOB on Friday.
In a statement on Monday, Saraki said due processes must be followed in accordance with the law before such declaration can have effect.
The senate president expressed hope that President Muhammadu Buhari would initiate the right process for declaring IPOB a terrorist group, saying this would demonstrate to the world at large that “we are a country that operates by laid down process”.
“I also wish to state that the announcement of the proscription of the group known as Indigenous People of Biafra (IPOB) by governors of the south-east states and the categorisation of the group as a terrorist organisation by the Nigerian military is unconstitutional and did not follow due process,” the statement read.
“Our laws make clear provisions for taking such actions and without the due process being followed, such declaration cannot have effect.”
Appealing for calm and Nigerians, Saraki called on all Nigerians to come together and find the right solution to the problem rather than worsening the crisis.
“Our brothers and sisters in the south-east, in particular, should continue to maintain peace and tranquillity and go about their lawful business. This crisis will not benefit anybody but would only expose innocent people to unwarranted danger,” it read.
“At this point, Nigerians outside the south-east who have worked to ensure that the crisis does not spread to other parts of the country deserve our commendation. I, therefore, call for continued efforts to sustain peace, unity and stability in all our communities so as to ensure that all residents, no matter their religion, tribe and creed remain protected and safe under the law.
“We must commend the military for their efforts in restoring peace to different parts of the country and sustaining the unity of the country.
“However, in the face of provocation, the military should allow themselves to be guided by their training which emphasises respect for human rights, even in war. Also, giving the nature of this particular situation, the military has every reason to be hesitant in the use of force.”
He said the army should not be over-stretched as there is need to protect the military “against dissipation of their fighting strength”.
The nation’s number three citizen also revealed the plan of the national assembly to embark on a “fact-finding mission” to the south-east.
“I want to also make it clear that the national assembly intends to embark on a fact-finding investigation aimed at determining what actually happened during the period of the military exercise in the south-east. We want to be able to sift the facts from the fiction and determine who did what. It is quite clear that all the facts are not yet known. We assure Nigerians that there will be no cover up. We intend to lay the facts bare.
“We want to remind Nigerians that the reason for embarking on constitution review by the national assembly was to enable us look into issues that are agitating the minds of Nigerians and creating tension among us. We have promised that the exercise would be continuous.
“We intend to keep that promise by further taking decisions that would strengthen and improve on our structures. The eighth national assembly, on resumption, will play its constitutional role by addressing all those issues that are agitating the minds of our people and over which they feel so strong.” (The Cable)

According to a report by Channels TV, Donald Trump’s administration ramped up the pressure on North Korea on Sunday ahead of a week of high-stakes diplomacy at the United Nations, warning Pyongyang will be “destroyed” if it refuses to end its “reckless” nuclear and ballistic missile drive.
With US officials and their allies scrambling to find ways to contain an increasingly belligerent Pyongyang, the US president will address the UN General Assembly on Tuesday and then confer Thursday with his Japanese and South Korean counterparts on the sidelines of the meeting.
Trump and South Korean President Moon Jae-In spoke by phone Saturday night and pledged “stronger pressure” on Kim Jong-Un’s regime, the South’s presidential office said, adding that the North must be made to realize that “further provocation” would put it on a “path of collapse.”
The Security Council last Monday imposed a new raft of sanctions on North Korea — but their impact depends largely on whether China, Pyongyang’s ally and main economic partner, will fully implement them and on Russia, which is hosting tens of thousands of North Korean workers.
Washington’s ambassador to the United Nations, Nikki Haley, kept up the rhetorical pressure ahead of the upcoming meetings in New York, asserting that if the North should pose a serious threat to the US or its allies, “North Korea will be destroyed.”
Trump’s earlier warning he would rain “fire and fury” on a recalcitrant North Korea, she said, was “not an empty threat.”
“None of us want war,” Haley added in an interview on CNN. “We wanted to be responsible and go to all diplomatic means to get their attention first. If that doesn’t work, General Mattis” — the US defense secretary — “will take care of it.”
– Enforcement in focus –
As the US and its allies emphasize the diplomatic track, South Korea is also deploying a state-of-the-art US missile defense system. In their latest call, the White House said Trump and Moon had committed to “take steps to strengthen deterrence and defense capabilities” of South Korea, offering no details of how it might do so.
Analysts say that in the event of hostilities, millions of people in the Seoul area, as well as the 30,000 US troops in South Korea, would be vulnerable to attack by the thousands of artillery pieces the North has positioned near the border, with potentially staggering casualties.
So far, every effort to persuade the North to back away from its fast-developing nuclear and missile programs — including its most powerful nuclear test yet, on September 3 — has proved futile, at times even seeming to prompt new acts of defiance from Pyongyang.
The North’s latest show of resistance came when it launched a long-range missile over Japan on Friday, just four days after the UN Security Council had passed a tough new package of sanctions.
At the request of the United States, the Security Council will hold a ministerial-level meeting Thursday on ways to enforce the latest sanctions, which include an export ban on textiles, freezing work permits to North Korean guest workers and capping oil supplies.
– ‘Rocket Man’ –
Haley said sanctions had already provided a “punch in the gut” to Pyongyang but that strict enforcement was crucial.
Separately, Trump’s national security advisor, H.R. McMaster, agreed that “the critical thing is going to be to get all countries, every one, to do all they can to enforce those sanctions, to do everything they can, short of a military conflict, to resolve this problem.”
But if diplomacy and economic pressure fail, he added, “We have to prepare all options.”
Pyongyang, an insular country with few outside contacts, says it needs nuclear weapons to protect itself from “hostile” US forces and is determined to build the capacity to deliver a nuclear warhead that could hit the US mainland.
North Korea said Saturday it was bent on nothing less than military “equilibrium” with the United States.
As his administration continued its efforts to rein in the North, Trump himself gave a more unbridled account of his latest diplomatic contacts.
“I spoke with President Moon of South Korea last night. Asked him how Rocket Man is doing. Long gas lines forming in North Korea. Too bad!” Trump tweeted, apparently finding a new nickname for Kim (McMaster confirmed that that was probably Trump’s intention).
Whether there are gas lines is unclear; very few people own cars in North Korea, outside military and government officials.
