Nigerian singer and entertainer, Anidugbe Oluwatobiloba Daniel, otherwise known as Kiss Daniel, has told former record label, G-Worldwide Entertainment, that it cannot stop him from using his stage name.
All has not been well between the 23-year-old and his former record label after the singer exited the label in October.
The record label on Tuesday said it had obtained a court injunction restraining Kiss Daniel from further use of his stage name, and the commercial exploitation of the songs recorded in the past four years.
However, Daniel in a statement through his lawyer, L&A Legal Consultants, stated that the federal high court, Lagos, refused G-Worldwide Entertainment the right to stop him from performing, recording or using the stage name Kiss Daniel.
The statement reads: “We are solicitors to Oluwatobiloba Daniel Anidugbe (Kiss Daniel) our attention has been drawn to the unfortunate publication by G-Worldwide Entertainment Ltd currently circulating on social media in respect of the exit of our client from G-Worldwide Entertainment Ltd. It has been said that “A lie unchallenged becomes the truth.
“In view of the above, we wish to say as follows on behalf of our client: The Federal High Court sitting in Lagos denied and refused G-Worldwide Entertainment Ltd.’s application for injunction restraining our client from performing, recording or using the stage name ‘Kiss Daniel’.
“In other words, the court refused to grant any order of injunction to restrain or prevent Kiss Daniel from performing, recording or using the stage name “Kiss Daniel” as requested by G-Worldwide Entertainment Ltd. This application for injunction was surreptitiously and secretly filed without notice to our client but the court saw through the deceit and refused the application.
“Kiss Daniel formally terminated his contract with G-Worldwide Entertainment Ltd via a letter dated 30th of October, 2017. The termination was done in compliance with the provisions of the Recording Contract between the parties. On 31st of October 2017, our client filed a law suit against G-Worldwide Entertainment Ltd at the Lagos State High Court and G-Worldwide Entertainment Ltd has already entered its appearance and file its defence/objection to the said suit.
“It took G-Worldwide Entertainment almost a month after our client had sued of the Lagos State High Court before G-Worldwide Entertainment Ltd deemed it fit to file the present suit, which is yet to be served on our client up till now. With regards to the name “Kiss Daniel”, our client was already using the combination of the stage name “Kiss” long before he ever met G-Worldwide Entertainment Ltd. The addition of “Daniel” (which is his middle name) was at his instance.
“It is therefore, laughable and unbelievable that G-Worldwide Entertainment Ltd will purportedly claim to own or have dashed our client his own middle name. The status quo under the contract between the parties as at the date G-Worldwide Entertainment Ltd filed its suit was that our client is no longer signed to G-Worldwide Entertainment Ltd since the termination was done a month earlier.
“Therefore, our client shall obey and comply with that status quo as directed by the court, it is a common principle of law that no court will stop an act which has already been completed. For the avoidance of doubt, we reiterate that the Federal High Court sitting in Lagos did not grant any injunction against our client, rather the court refused the application of G-Worldwide Entertainment Ltd, for an injunction to restrain our client from performing, recording or using the stage name Kiss Daniel.”

The rift between singer, Anidugbe Daniel, aka Kiss Daniel, and his estranged record label, G-Worldwide Entertainment, has gotten messier.
Recall that Kiss Daniel had recently been promoting a new record label, Flyboy Inc, under whose imprint he released his latest single, No Do. As it turns out, G-Worldwide is not pleased with Daniel’s activities and the company has dragged him to court, accusing him of “taking steps to appoint a new manager, solicit for bookings, and has continued to negotiate and enter performance agreements in respect of the songs from the album New Era, and Evolution which is set to be released soon containing singles such as Yeba, For You, Senorita, Sofa and others, produced under the contract, including using the stage name ‘Kiss Daniel’ without the company’s prior consent and permission.”
In a statement made available to our correspondent by G-Worldwide’s lawyers, Calmhill Partners, it was stated that a Federal High Court in Lagos had on November 30, granted an order that all parties should maintain the status quo under the contract. The company further warned the general public against contracting any business with Kiss Daniel. The statement read, “The import of the order being that the state under which the parties existed under the contract should be preserved until the court makes a determination of the motion on notice filed by the company. All and any dealings in respect of the upload, distribution, and or performance of any of the songs, as well as the use or exploitation of the name ‘Kiss Daniel’ can therefore only be entered or made with the prior written consent and permission of the company as provided under the contract.”
A copy of the court order signed by Hon. Justice Babs Kuewumi was also made available to our correspondent, and it partly reads, “It is hereby ordered as follows that in the interim both parties are ordered to maintain the status quo ante Bellum under the recording contract pending the hearing of the motion on notice.” The case was adjourned till January 9, 2018.
Meanwhile, the statement by Calmhill Partners, which was signed by Aso Kalu Etea, warned that anyone who conducted business with Kiss Daniel pending the determination of the suit risked being held in contempt of court. It read, “The general public and the whole world is further cautioned that as the matter is now before a court of law (subjudice), and following the order to maintain status quo, any unauthorized upload, distribution, exploitation, performance, sales, and use of the songs (from the New Era andEvolution albums), or stage name ‘Kiss Daniel’, in any show, event, downloading or streaming platform, will be in violation of the order of the Federal High Court. Anyone who does or continues to do so shall be liable as an accomplice for contempt of court, and the full weight of the law will be brought against that person as a contemnor. Any person or organization who negotiates, or enters into any agreement with Mr. Anidugbe to engage him on the basis of his presumed rights over the songs in both albums, or the use of the stage name ‘Kiss Daniel’, does so at his or her own risk and peril.”
However, in a chat with a representative of Flyboy Inc, who declined to give his name, the company maintained that it was not aware of any court order. He said, “We are not aware of any court order. The official status of Kiss Daniel is Flyboy Inc and that’s what he’s operating with. I cannot say if his contract with G-Worldwide has been dissolved but to the best of my knowledge, he is with Flyboy Inc now. His new single was released under Flyboy and all other activities would be with the label as well.”Punch

The Nigerian Police Force has reacted to calls by Nigerians for the scrapping of its Special Anti-Robbery Squad, SARS.
There is ongoing social media campaign calling on police to scrap its SARS unit.
But the police said contrary to claims of wrongdoings against SARS by some “criminals”, the anti-robbery unit had done a lot in sanitising the country.
The police said those carrying out the campaign in the social media were armed robbers.
It also asked well meaning Nigerians to disregard what it described as so-called special media campaign against SARS.
Speaking with Vanguard, Force Public Relations Officer, Jimoh Moshood, a Chief Superintendent of Police, CSP, vowed that the criminals won’t have their way.
He said, “Anybody calling for scrapping of SARS is an armed robber, let him come forward so that we can investigate him.
”Any complaints they give against any police personnel, everybody knows that we don’t hide it.
“We have a Public Complaints Bureau which handles complaints. So if anybody is calling for scrapping of SARS, we don’t need to be reminded that they are criminals just using the social media.
“If there are robbers that are operating and Special Anti-Robbery Squad engage them and somebody would now put something in the social media and say they should scrap SARS, I think it’s unfortunate.
”If there are specific allegations against any police officer whether SARS or no SARS, there’s a control mechanism for any of us that violates the rights of Nigerian citizens to be dealt with appropriately.
“You have seen instances where police officers have been tried, found guilty and charged to court.
“Those mechanisms are there, so it would be mischievous for anybody to call for scrapping of SARS. You want armed robbers to take over everywhere?”
”So, those who are calling on the scrapping of SARS are people to be suspected, I think they are robbers themselves.
“If there are complaints of atrocities against any police officers, they are being dealt with appropriately, we don’t hide them.
”You have been reading how police men that misbehave in their lines of duties are being dealt with. So anybody that is calling for scrapping of SARS has something to hide.
“The police authorities cannot and will not scrap the Special Anti-Robbery Squad, SARS for these criminals to thrive because it’s not our problem.
“The people that have been fighting armed robbery, fighting kidnapping and make a lot of successes?
”Look at the number of people they have arrested along Abuja-Kaduna highway, look at the case of Evans. Don’t you know that Intelligence Response Team has elements of Special Anti-Robbery Squad in them.
”I’m just trying to let you know the viability, so we shouldn’t be dancing to the tone of the social media, that’s the comedians centre.
“If a person would call for the scrapping of SARS, is the person not an armed robber himself?
“They are just carrying their campaign in the social media.”
