Another federal judge has overruled the Trump administration’s efforts to end a popular immigration program — this time saying the government has to accept new applications.
The ruling on the Deferred Action for Childhood Arrivals program, however, won’t take immediate effect, with the judge delaying the ruling for 90 days to allow the administration to make its case in a new memo justifying the end of the program.
Similar to the other rulings, Judge John Bates concluded that the wind-down of DACA was “arbitrary and capricious” because the Department of Homeland Security failed to “adequately explain its conclusion that the program was unlawful.” The judge also accused the government of providing “meager legal reasoning” to support its decision.
A George W. Bush appointee to the US District Court for the District of Columbia, Bates delayed the implementation of his ruling “to allow the agency an opportunity to better explain its rescission.”
In response to the ruling, the Justice Department said it stands by its original reasoning, calling DACA an “unlawful circumvention of Congress,” and that it intends to continue making its case to the courts.
“The Department of Homeland Security therefore acted within its lawful authority in deciding to wind down DACA in an orderly manner,” spokesman Devin O’Malley said in a statement. “Promoting and enforcing the rule of law is vital to protecting a nation, its borders, and its citizens. The Justice Department will continue to vigorously defend this position, and looks forward to vindicating its position in further litigation.”
In his 60-page decision, Bates took the administration to task for its justification for ending DACA, which was almost entirely based on a threat from Texas and a handful of other states to challenge DACA in court.
Bates called the move “particularly egregious” given the hundreds of thousands of DACA recipients, young undocumented immigrants who came to the US as children, protected under the program over its five years. Given how many people’s lives were built on the protections from DACA, Bates said, “its barebones legal interpretation was doubly insufficient.”
Bates concluded that the argument that a Texas court would have likely immediately halted the program “was so implausible that it fails even under the deferential arbitrary and capricious standard.”
The DACA program has already been resumed after President Donald Trump sought to end it in September, after two federal judges issued nationwide rulings to accept renewals of the two-year permits issued by the program and after the Supreme Court declined to circumvent the appeals process to overturn those decisions.
But while the DHS has been processing renewal applications under those rulings, as the appeals make their way through the courts, Tuesday’s ruling was the first to order the program to resume accepting new applications — potentially opening the program to tens of thousands more immigrants than the roughly 700,000 currently protected.
In September, the administration defended ending the program by saying it was likely to fall in the courts anyway, arguing a six-month wind-down of the program would be more orderly than a sudden end brought by the courts. No court has found DACA to be unconstitutional.

The Lagos State Government has said forensic and eyewitness evidence proves that Ali Zainab Nielsen popularly known as Alizee was killed by her husband Peter Nielsen, Punch reports.
Peter, a Danish citizen, had been arrested and charged to court after Alizee and her daughter Petra were found dead.
Alizee’s sisters who stayed with the couple said they saw Peter smash her head against a wall repeatedly. The police also revealed that their daughter was poisoned.
Peter had appeared before the court and pleaded “Not Guilty.”
The Lagos State Attorney General, Adeniji Kazeem, has said the evidence available proves, without a shadow of doubt, that Peter is indeed guilty of the killings. He said:
The Office of Attorney General and Commissioner for Justice on the 19th of April, 2018 issued Legal Advice to the effect that a prima facie case of murder Contrary to Section 223 of the Criminal Law of Lagos State, 2015 has been established against the suspect, Peter Nielsen (M) – a Danish National. The suspect is therefore to stand trial; before the High Court of Lagos State for the murder of his Nigerian wife and 3 year old daughter.
There is overwhelming and compelling evidence both forensic and direct eye witness account showing without doubt that the victims were killed by the suspect. There is also evidence that there was a history of domestic violence against the victim by the suspect.

Governors under the All Progressives Congress (APC) have endorsed President Muhammadu Buhari for a 2nd term in office, The Cable reports.
The governors made this known after a meeting with the president at the State House.
Chairman of the APC Governors’ Forum, Rochas Okorocha, said Buhari has to go on with his vision to rescue Nigeria. He said:

VoiceTv Nigeria released a video tgar showed Senator Dino Melaye being rushed into the Zankili Medical Center, Mabuchi, today in Abuja.
According to TheCable, Melaye was reportedly being led to court by the policemen on Tuesday afternoon when he attempted to escape thereby sustaining injuries when he jumped out of a moving police vehicle.
It was gathered that the police vehicle carrying Melaye turned to an unknown location when it got to Area 1, Abuja. He was said to have immediately jumped out of the vehicle.
Addressing journalists at the hospital including TheCable, an eyewitness simply identified as Peter said:
“I was there in Area 1 when the police vehicle stopped somewhere and amid the confusion, there were shouts of ‘shoot him, shoot him’.
He has been saying it that they want to take his life and we can see that now. Yesterday, about 200 policemen were in house. They were there till this morning. When he came out, he told them ‘okay, I’m going to go with you people to the police station.’ That he is not a criminal and that they don’t even have any arrest warrant on him. But he followed them.
It was later this afternoon, while he was being taken to court, around that Area 1, the crowd had gathered and the police officers were there with him. I don’t know if he was pushed out of the vehicle or not but amid the confusion, they later moved him from there.
The police has now rearrested the senator, and in a statement to TheCable, said “hoodlums and miscreants in two Toyota hilux vehicles blocked the police vehicle” while Melaye was being taken to court. The statement read:
At about 12pm of today (Tuesday), Sen. Dino Melaye while in lawful custody of the Nigeria police force and being taken for arraignment in federal high court, Lokoja from Abuja, escaped from lawful custody when hoodlums and miscreants in two Toyota hilux vehicles blocked the police vehicle conveying Senator Dino Melaye around Area 1 roundabout, Abuja and in the process the senator jumped out of the police vehicle through the window and was rescued from the police men by hoodlums and miscreants to an unknown destination.
The police team re-enforced and trailed Senator Dino Melaye to Zankli Hospital, Abuja where he was re-arrested. The senator would be arraigned in court without further delay.
Meanwhile, one of the Toyota hilux vehicles used by the hoodlums and miscreants in aiding the escape of the senator has been recovered by the police investigation team. The inspector general of police has therefore directed a thorough investigation into the circumstances leading to the rescue and escape of Senator Dino Melaye from lawful custody.”
The police is yet to take Melaye away from the hospital, as he’s still being treated.
Dino Melaye who is representing Kogi West District was arrested at the Nnamdi Azikwe International Airport, Abuja on Monday.

Dino Melaye, the senator representing Kogi West District, is now in police custody, The Cable reports.
He had been stopped from travelling to Morocco on Monday by the Nigerian Immigration Service (NIS) on the order of the police.
He had returned home to find the police waiting at his doorstep, he further revealed on Monday.
Melaye, Tuesday morning, wrote on his Twitter that he’d make himself available to the police.
According to The Cable, Melaye drove into the office of the special anti-robbery squad (SARS) in Abuja.
